ICE & DHS Gives Flexibility on Form I-9 During COVID-19

ICE and DHS now allow certain employers to defer physical presence requirements associated with Form I-9 and section 274A of the Immigration and Nationality Act. 

Form I-9 is an Employment Eligibility Verification Form. In a normal process, an in-person review of an employee's identity and employment authorization documents is required before an employee can start working. Now eligible employers do not need to review the documents in person, instead, they could use video link, fax or email, or other remote channels, as long as they provide written notice of their remote on-boarding and remote work policy on Form I-9.

The policy was originally set to expire August 19, 2020 and now has been extended for another 30 days (to September 19th, 2020). 

**Update on 11/20/2020: The policy has been extended to December 31st!

**Update on 9/30/2021: This policy has been extended to December 31st, 2021!

**Update on Dec 2021: This policy has been extended to April 30th, 2022

Who is eligible for the remote Form I-9 verification process?

This flexibility extension only applies to remote workplaces where employers have restrictions due to COVID-19. Check with your employers to confirm their eligibility.
