USCIS Suspends Biometric Requirements for H-4, L-2 and E visa holders

Did you not get your biometric appointment notice? USCIS announced that they will be suspending biometric screening requirements for several visa holders, including H-4, L-2, E-1, E-2 and E-3 visas. Let's look at more details:

USCIS will pause all biometric requirements for H-4, L-2, E-1, E-2, and E-3 visa holders.

How long is the suspension? 

The suspension begins on May 17th, 2021 and will stay effective until May 17th, 2023 (two years!) However, the suspension can be extended or revoked by USCIS director at any time. 

Who will be affected?

Other than the visa types mentioned above, this suspension also applies to Form I-539, Application to Extend/Change Nonimmigrant Status applications with a pending biometric service appointment notice. 

Newly filed applications received by USCIS after May 17th, 2021 will be affected.

Why suspending the bio requirements?

USCIS says the suspension is meant to reduce the lengthy delays in processing applications. COVID-related factors and other capacity limitations have created a huge backlog of cases awaiting biometrics appointments. The delays for these biometric appointments in turn caused delays for Form I-765 (work permit) Application for Employment Authorization. 

Can I still be required for biometrics?

Possible! USCIS retains discretion to require biometrics if necessary. Any applicant may be scheduled for an ASC appointment and be required to submit biometrics for identity verification and/or other purposes. So be patient and pay attention to new updates!
