USCIS Premium Processing Resumes in Phases for I-129 & I-140

After a long wait time, USCIS finally announced that they will resume the premium processing in phases for certain petitions including form I-129, Petition for a Nonimmigrant Worker, and form I-140, Immigrant Petition for Alien Workers.

When Will USCIS Resume Premium Processing?

Here's a summary list of tentative dates when USCIS will start accepting premium processing requests:

  • June 1st I-140 petitions
  • June 8th 
    • H-1B petitions that are cap-exempt
    • All other form I-129 for nonimmigrant classifications 
  • June 15th H-1B petitions that filed an I-907 concurrently with I-129 before June 8th and are cap-exempt because the employer is cap-exempt or the beneficiary is cap-exempt based on a waiver
  • June 22nd all other form I-129 petitions, including
    • All H-1B cap-subject petitions
    • All other form I-129 petitions for nonimmigrant classifications that filed an I-907 concurrently with I-129
