*New update on September 27th, 2021: USCIS is further extending its 60-day deadline extension policy for responses to various agency actions to January 15th, 2022.
USCIS announced recently that they are extending the flexibility for responding to agency requests during the pandemic, including:
- Requests for Evidence
- Continuations to Request Evidence
- Notices of Intent to Deny
- Notices of Intent to Revoke
- Filing date requirements for Form N-336, Request for a Hearing on a Decision in Naturalization Proceedings
- Notices of Intent to Rescind and Notices of Intent to Terminate regional investment centers
- Filing date requirements for Form I-290B, Notice of Appeal or Motion
Check your notice issuance date listed on the request, if they are between March 1st and September 11th, 2020, then you will have a little longer time to prepare for your response.
- In June 2020, USCIS released the extension rule for applicants who receive notice between March 1st and July 1st, 2020.
*On September 11th, USCIS updated the dates to "Between March 1st and January 1st, 2021" inclusive!- *Updates on Dec. 18th, 2020: This extension covers request notice or decision between March 1st, 2020 and Jan 31st, 2021, inclusive.
When is My RFE Due?
You have 60 days after the original response due date set in your notice to submit your response to USCIS. This is a special extension to assist applicants during the COVID-19 pandemic.
