H1B Spouse Can Work in the US Again
What is H-4 Visa?
H-4 is a visa type issued by USCIS to immediate family members of the H-1B visa holders (a popular work visa for aliens/foreigners). Most H-4 visa holders are Indian IT professionals.
Biden Withdraws Trump's H-4 Visa Rule
The work authorization for H-4 visa holders started from Obama-era. Obama issued a rule to give employment authorization cards to the spouses of Indian professionals on H-1B visas. Most H-4 visa holders are in the process of seeking employment-based lawful permanent resident status in the US.
In 2017, the Trump administration rescinded the H-4 visa work authorization rule, and now President Biden withdraws the rule once again to allow H-4 visa holders to work in the US.
"This rule is an important step towards rectifying gender disparities in our immigration system, as over 95% of H-4 visa holders who have secured work authorizations are women." - According to the Department of Homeland Security (DHS)
Congratulations to those who can now benefit from the work authorization rule! I am sure there will be more revamping coming pretty soon. So keep your eyes peeled and check back often!
